These Terms of Use (“Terms”) govern your access to and use of the Pressia platform, websites, and related services (the “Service”), operated by Pressia Pty Ltd (ABN 32 691 495 397) (“Pressia”, “we”, “us”, or “our”).
By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation, and “you” refers to that organisation.
1. The Service
Pressia is an AI-assisted workspace that helps communications and public-relations teams triage, assess, draft responses to, and manage inbound media enquiries. We continually improve the Service and may add, change, or remove features from time to time.
2. Eligibility and accounts
You must be at least 18 years old to use the Service. You agree to provide accurate account information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at contact@pressia.io if you suspect any unauthorised use.
3. Organisations and team members
The Service is organised around shared workspaces. Workspace owners and admins can invite members, manage roles and permissions, and configure connected mailboxes. If you join a workspace, an admin may control your access and view content within that workspace. You are responsible for your team members’ compliance with these Terms.
4. Acceptable use
You agree not to:
- use the Service in breach of any law, or to infringe the rights of others;
- upload or process content you are not authorised to share, or that is unlawful, harmful, or malicious;
- attempt to gain unauthorised access to, disrupt, or compromise the integrity or security of the Service;
- reverse engineer, scrape, or copy the Service except to the extent permitted by law; or
- resell or make the Service available to third parties except as expressly permitted.
5. Your content
You retain all ownership of the content you submit to the Service, including media enquiries and related correspondence you forward or upload (“Customer Content”). You grant Pressia a worldwide, non-exclusive licence to host, process, and display Customer Content solely to provide and improve the Service.
You are responsible for ensuring you have the necessary rights to submit Customer Content and that doing so complies with applicable laws, including privacy laws in respect of any personal information of third parties (such as journalists) contained in that content.
6. AI-generated content
The Service uses artificial intelligence to generate assessments, summaries, and suggested drafts. AI output can be inaccurate, incomplete, or unsuitable for your circumstances. It is provided as a drafting and decision-support aid only.
You must review AI-generated content before relying on or sending it, and you remain solely responsible for any communication you ultimately send. To the extent permitted by law, Pressia does not warrant the accuracy, completeness, or fitness for purpose of AI-generated content.
7. Intellectual property
The Service, including all software, design, and content we provide (excluding Customer Content), is owned by Pressia or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. If you provide feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without restriction.
8. Third-party services
The Service integrates with third-party services, such as email providers and identity providers. Your use of those services is governed by their own terms, and we are not responsible for them. The Service may also link to third-party websites we do not control.
9. Pilot and beta features
Some features, or your entire access, may be offered on a pilot or beta basis and may be governed by separate pilot terms provided to you. Pilot and beta features are provided “as is”, may change or be withdrawn, and may contain bugs or incomplete functionality.
10. Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may suspend access for maintenance, updates, or to protect the security or integrity of the Service.
11. Fees
Pilot access is provided at no charge for the pilot period. Paid plans are offered under a separate subscription agreement, which will set out the applicable fees and billing terms.
12. Consumer guarantees and disclaimers
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under that law that cannot lawfully be excluded.
Subject to those rights, and to the maximum extent permitted by law, the Service is provided “as is” and “as available”, and we exclude all other warranties, express or implied. Where we are liable for breach of a non-excludable guarantee, our liability is limited (at our option) to re-supplying the relevant services or paying the cost of having them re-supplied.
13. Limitation of liability
To the maximum extent permitted by law, neither party is liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service. Our total aggregate liability arising out of or in connection with these Terms is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the liability (and, for pilot access provided at no charge, is limited to AUD $100).
14. Indemnity
You agree to indemnify Pressia against any loss, liability, or cost arising from your breach of these Terms, your misuse of the Service, or your Customer Content, except to the extent caused by our own negligence or wrongful act.
15. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, or where necessary to comply with law or protect the Service or its users. On termination, your right to use the Service ends; provisions that by their nature should survive (including ownership, disclaimers, and limitation of liability) will survive. Data export and deletion for pilot participants are handled in accordance with the applicable pilot terms.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Pressia submit to the exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.
